Important Change to the Miranda Law

The majority opinion, written by Justice Anthony Kennedy, said a suspect who goes ahead and talks to police after being informed he doesn’t have to have waived his right to remain silent.

The right to remain silent and have a lawyer is at the head of the warnings that police recite to suspects during arrests. Tuesday’s majority says that subjects must break their silence and inform police they are going to remain quiet to stop them being questioned, the same as they have to tell police they want a layer.

What this decision means is that the police can continue shooting questions at a suspect who refuses to talk in the hopes that the person will break and give them information.
